By accessing, registering, or using the Platform, users (“User”, “Patient”) and physiotherapists (“Physio”, “Healthcare Professional”) agree to these Terms. If you do not agree to these Terms, you must not use the Platform.
1. Eligibility and Acceptance
1.1 The Platform is intended for use by qualified physiotherapists and patients under their supervision.
1.2 By registering or accessing the Platform, you confirm that you are at least 18 years of age and capable of entering into legally binding agreements.
2. Role of Remote Physios
2.1 The Platform provides AR-based physiotherapy games designed to support rehabilitation and therapy.
2.2 Remote Physios does not replace medical advice or professional clinical judgment.
2.3 The selection, prescription, and monitoring of AR games must be done by a qualified physiotherapist.
3. User Responsibilities (Patients / End Users)
3.1 Users must:
- Use AR games only in a safe and suitable environment, free from obstacles, hazards, or distractions.
- Ensure adequate physical space, lighting, and support before beginning any AR exercise.
- Stop using the Platform immediately if they experience pain, discomfort, dizziness, or any adverse reaction.
- Follow the instructions of their assigned physiotherapist regarding game selection, frequency, and duration.
3.2 Users acknowledge that:
- AR games are assistive tools, not a substitute for medical treatment.
- Results may vary depending on individual conditions, compliance, and external factors.
- They remain solely responsible for their participation and health outcomes.
4. Physiotherapist Responsibilities
4.1 Only qualified and licensed physiotherapists are authorized to prescribe, monitor, and guide patients in using AR games.
4.2 Physiotherapists must:
- Recommend appropriate games based on clinical judgment, patient needs, and safety considerations.
- Monitor patient progress using the Platform and adjust exercises as required.
- Ensure that no unsafe or medically contraindicated exercises are prescribed.
4.3 Physiotherapists are responsible for the accuracy of clinical advice given through the Platform.
5. Indemnification
5.1 Users and Physiotherapists agree to indemnify, defend, and hold harmless OsteoQure Healthcare Pvt. Ltd., Remote Physios, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, expenses, or losses (including legal fees) arising from:
- Improper or unsafe use of the Platform.
- Negligence, misconduct, or violation of these Terms.
- Injury, accident, or health complications resulting from AR game participation outside prescribed safe practices.
6. Limitation of Liability
6.1 The Company provides the Platform “as is” without warranties of any kind, express or implied.
6.2 The Company shall not be liable for:
- Any injury, accident, or medical complication resulting from the use of AR games.
- Errors or omissions in physiotherapist recommendations.
- Indirect, incidental, or consequential damages arising from Platform use.
7. Safety and Environment
7.1 Users must choose to play AR games in a safe environment with:
- Non-slippery flooring, adequate space, and no sharp edges or obstacles.
- Support equipment such as mats, chairs, or parallel bars if required.
- Supervision or assistance where clinically advised.
8. Data Privacy
8.1 Remote Physios may collect personal and health-related data in compliance with applicable privacy laws.
8.2 By using the Platform, Users consent to the collection, storage, and processing of data as per our Privacy Policy.
9. Intellectual Property
9.1 All AR games, software, content, trademarks, and related intellectual property belong exclusively to OsteoQure Healthcare Pvt. Ltd.
9.2 Users and Physiotherapists are granted only a limited, non-transferable license to use the Platform for personal rehabilitation purposes.
10. Termination
10.1 The Company reserves the right to suspend or terminate access to the Platform for any User or Physiotherapist found misusing the Platform, violating these Terms, or engaging in unsafe practices.
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bhopal, Madhya Pradesh.
